NZ Citizen Family Relationship Visa

Are you a New Zealand citizen with a partner who is not from NZ or Australia and they would like to join you in Australia? If you arrived in Australia after February 2001, then your non-NZ or Aussie citizen partner will require an Immigration visa to join you. This visa option will allow them to work, study or just enjoy life with you here in Australia.

Parent - temporary and permanent

Parents of Australian permanent residents or citizens that meet the balance of family test may be eligible to sponsor their parents to permanently live in Australia with them. These visas can be very time consuming to prepare and we recommend employing a migration agent to help you through the many steps and details involved.

Partner – temporary and permanent

Basic eligibility includes needing to be either married, de facto (prescribed state register) or have been living together for 12 months to apply. Australian Immigration will want to know all the different aspects of your relationship including the financial, social and emotional aspects as well as the nature of your commitment and household

Criteria

You may be eligible if you fit one of the below
· Are you married to an Australian citizen, Australian permanent resident or eligible New Zealand citizen?
· Are you in a Defacto relationship with an Australian citizen, Australian permanent resident or eligible New Zealand citizen?
· Do you plan to marry an Australian citizen, Australian permanent resident or eligible New Zealand citizen

Partner visa

Include married or de facto partners (including those in a same-sex relationships). The application can be lodged in Australia if the applicant is in Australia and holds a visa that allows this to occur, or alternatively outside Australia.

Prospective Marriage

This is commonly called nicknamed the ‘fiancée visa’. It has a nine month validity period and the application must be lodged outside of Australia. One in Australia, the couple may marry within the nine months to then be eligible for the Partner Visa which is then lodged in Australia.

Defacto

Partner visa can include defacto OR married couples. To meet the initial ‘defacto’ criteria couples have to:
· have either lived together for 12 months
OR
· have lived together for less than 12 months but have a government defacto relationship certificate
By lodging your application with a government defacto relationship certificate entitles you to apply for the partner visa.

General Skilled

The skilled visa program is designed for skilled migrants with occupation on the relevant skilled lists. These visas require applicants to submit an Expression of Interest (EOI) and meets the threshold of points. Contact us for an accurate points assessment.

Applicants must be “migration ready” with all information at hand at the time of application for an EOI. This means that English tests and skills assessments must be done.

The perfect way to work

In some cases, you may need to obtain a skills assessment for other employer-nominated visas.

The assessing authority will review your qualifications and work experience to determine whether or not you possess the necessary skills to undertake your chosen occupation in Australia. Although the requirements for each occupation (and each assessing authority) differ, as a minimum, you will generally be required to provide evidence of your:

  • Identity (e.g. passport)
  • Qualifications (e.g. award certificates and academic transcripts)
  • Work experience (e.g. written work references, tax records, employment contracts)
  • Overseas or Australian registration or licensing, if applicable (e.g. registration/licensing document)


In addition, you must pay the fee charged by the authority for the skills assessment, and provide any other documents or information required.

Citizenship
Resident Return Visa (RRV)
Your permanent residency is granted for a 5 year period. If you do not choose to take up Australian citizenship, then you will need a Resident Return Visa if you wish to leave Australia and come back. There is no limit of the number of RRV you can have.
Evidence of Citizenship:
Have you had a baby In Australia when you hold permanent residency? Have you lost your citizenship certificate and need it to apply for a new passport. If you have acquired Australian citizenship by operation of law, and want evidence you are citizen, we can help.
Citizenship by Descent

If you have a parent that is a citizen and you were born overseas you may be eligible for citizenship by conferral.

Ensure that the person you are claiming descent from was your parent at the time of your birth and was also an Australian citizen at the time of your birth

Citizenship by Conferral

If you have been a permanent resident for 12months and resident for 4 years and meet other criteria, then you may be eligible for Citizenship by conferral.

  • Be a permanent resident or a New Zealand citizen holding a Special Category (subclass 444) visa (SCV)
  • Plan to maintain living in Australia and have links
  • New Zealand citizens holding an SCV are considered permanent residents for citizenship purposes.
  • A parent can include a dependent child aged 15 years or younger in their application at no extra cost. The child must be a permanent resident.
  • You may already be an Australian citizen and eligible for Evidence of Australian citizenship if you were born in Australia:

And have been ordinarily resident in Australia throughout the first 10 years from your birth

Student
Student Visa

A student visa allows you to study in an eligible course, work up to 48 hours a fortnight when you course is in session and full time on course holidays. Masters by Research or PHD students have no work restrictions.

Employer Sponsored

Employer Nomination Scheme (ENS - 186) visa

If you have a sponsor, three years of work experience after qualification and a positive skills assessment and the correct English and meet other criteria, then this visa could be for you.

This visa is for permanent residency through employer sponsorship. . This is also the visa that 482 visa holders often transition onto through the temporary transition scheme.

Skilled Employer Sponsored Regional (Provisional) Visa (subclass 494)

This visa is to assist regional-based employers fill shortages in their designated regional areas. It is granted for 5 years and if you hold it for 3 years it can be used to transition to permanent status with the 191 visa providing certain criteria are met. Designated regional
areas include all of Australia except Sydney, Melbourne and Brisbane.

Temporary Skilled Shortage Visa (TSS – subclass 482)

This visa can be granted up to 4 years and requires you to be nominated by an approved sponsor, We work with the employer too to effectively meet the three stages of this application. There is no age limit. You must meet relevant English language requirements, have the skills and 2 years experience to do the job.

Subsequent Entrant
